Sexual harassment case against Vice Chancellor dismissed... Supreme Court makes important comment

The Supreme Court has dismissed the sexual harassment case against West Bengal's National University of Juridical Sciences (NUJS) Vice Chancellor Nirmal Kanti Chakrabarti but the court also ordered that the incident will always be mentioned in the professor's biodata. The court said that such acts cannot be forgiven and the culprit should be given such a punishment that he remembers it for the rest of his life.

A case of sexual harassment was registered against Nirmal Kanti Chakrabarti, Vice Chancellor of National University of Judicial Sciences (NUJS), West Bengal, which has been dismissed by the Supreme Court. But, the Supreme Court has ordered to include this heinous act in the professor's biodata forever.

A two-judge bench of Justice Pankaj Mithal and Prasanna B Varal in the Supreme Court, while dismissing the petition filed against the Vice Chancellor, said, "Such acts can be forgiven, but the wrongdoer should get such punishment that hurts him for the whole life."

Case of 2023

The Supreme Court said, "This decision should be included in the Vice Chancellor's biodata." The victim had filed a complaint of sexual harassment against the Vice Chancellor on 26 December 2023. However, the local complaint committee rejected it, as the sexual harassment took place in April 2023, which was more than the stipulated time i.e. 6 months.

According to the victim, Vice Chancellor Nirmal Chakraborty became a part of the university in July 2019. Two months later, on September 8, Nirmal offered the victim to go for dinner. When the victim refused, he not only touched her hand inappropriately but also threatened to stop her promotion if she did not agree.

Accusation against the victim in 2023

In October 2019, the Vice Chancellor again made an offer to the victim and when she refused, the promotion was stopped. The victim was promoted on 2 April 2022. In April 2023, the Vice Chancellor again called her and offered her to go on a trip to a resort. When the victim refused again, Nirmal threatened to ruin her career.

On 29 August 2023, the victim was removed from the post of director on charges of corruption and an inquiry was ordered against her. Hearing the case, the Supreme Court said, "Removing the victim from the post of director on the basis of past incidents does not fall under the purview of sexual harassment." This is why the court dismissed the case.
